1. Scope, Ecosystem & Acceptance

These Terms of Service ("Terms") govern the access and use of the services, websites, native mobile applications, APIs, and content provided by Roominac Interactive Technologies (SMC-Private) Limited(referred to herein as "Roominac", "we", "us", or "our").

The Roominac ecosystem comprises:

• Public Discovery Platform: Our high-SEO web presence accessible at roominac.com and related localized subdomains.
• App Portal & Web Experience: The authenticated single-page application at app.roominac.com.
• Native Mobile Applications: The Roominac iOS application (available via Apple App Store) and Roominac Android application (available via Google Play Console).
• Cloud Infrastructure: High-performance encrypted databases, real-time messaging services, and distributed media delivery networks.

By creating an account, browsing listings, executing a booking, or publishing a property, you affirm that you are at least 18 years of age, legally capable of entering into binding contracts under the Contract Act, 1872, and possess the necessary authority if acting on behalf of an entity or corporate host.

2. Account Registration, Security & Mandatory NADRA KYC

Trust and physical safety are the foundational pillars of Roominac. To eliminate unauthorized subletting, financial fraud, and unlawful occupancy, we operate a strict identity verification protocol:

2.1 Identity Requirements

• Pakistani Citizens & Overseas Nationals: Must submit a clear, un-obscured digital copy of their valid Computerized National Identity Card (CNIC), Smart National ID, or National Identity Card for Overseas Pakistanis (NICOP).
• International Guests & Diplomats: Must upload a valid Machine-Readable Passport accompanied by an active Pakistani entry visa or e-Visa document.
• Facial Biometrics & Liveness: Users must submit a real-time liveness selfie via our mobile camera integration. Roominac matches facial geometry with the photographic identity document to prevent proxy reservations or identity theft.

2.2 Account Confidentiality

You are solely responsible for maintaining the confidentiality of your login credentials (passwords, OTP codes, and authentication tokens). You agree to immediately notify Roominac Support of any unauthorized access. Roominac will never solicit your password or multi-factor SMS codes under any circumstances.

3. Merchant of Record, Booking Execution & Escrow Model

To safeguard both travelers and property operators, Roominac serves as the exclusive Merchant of Record (MoR) for every financial transaction on the platform.

3.1 Authorized Payment Channels

We accept local and cross-border digital payments via authorized banking channels and regulated payment clearing rails (including SBP Raast and 1Link), including:

• State Bank of Pakistan Raast Instant P2M Payments.
• Domestic Debit/Credit cards (Visa, MasterCard, PayPak, and UnionPay).
• Mobile Wallets (EasyPaisa, JazzCash, SadaBiz, and Nayapay).
• International Credit & Debit Cards for foreign tourists and overseas Pakistanis.

Off-Platform Payment Prohibition: Transacting, soliciting, or transferring booking payments outside Roominac (e.g., cash handoffs at check-in or off-platform bank transfers) is strictly prohibited. Off-platform transactions immediately void all guest protections, insurance coverage, and the 24-Hour Stay Guarantee, and will result in permanent account deactivation.

4. Host Obligations, Quality Standards & Property Readiness

Hosts listing accommodations (including Apartments, Guest Houses, Luxury Farm Houses, Hostels, and Boutique Hotels) must adhere to rigorous hospitality and transparency benchmarks:

4.1 Listing Fidelity & Media Integrity

• Truth in Photography: Photos, floor plans, and video reels uploaded to Roominac must accurately represent the property's current condition. Using deceptive wide-angle lenses, outdated renovation photos, or unlicensed stock images constitutes a breach of contract.
• Accurate Geolocation: The exact pinpoint location on Google Maps must correspond to the actual physical entrance of the premises.
• Utility Transparency (Load-Shedding & Climate Control): Due to infrastructure realities in Pakistan, hosts must truthfully declare whether the property features UPS backup, high-capacity solar systems, or fuel-driven generators capable of sustaining Air Conditioning (AC) during power outages.

4.2 Health, Safety & Legal Compliance

• Hygiene: Fresh linens, sanitized bathrooms, clean drinking water, and professional pest management are mandatory prior to every check-in.
• Emergency Provisions: Hosts must equip properties with accessible fire extinguishers, first aid kits, and prominent emergency contact placards (Rescue 1122, Police 15, and building management).
• Local Regulations: Hosts represent that their property complies with all local zoning bylaws, society bylaws (e.g., CDA, DHA, Bahria Town, LDA, KDA), and applicable hospitality tax registrations.

5. Guest Code of Conduct, House Rules & Damage Liability

Guests are expected to treat host properties, residential neighbors, and community standards with absolute respect.

5.1 Prohibited Activities

• Unlawful Gatherings & Narcotics: Any conduct prohibited under Pakistani criminal law—including the use or distribution of illicit substances, illegal weapons, unauthorized commercial shoots, or disruptive loud parties—is strictly banned.
• Occupancy Limits: The number of occupants residing in the property must not exceed the maximum guest count declared at checkout without explicit host written approval.
• Quiet Hours: Guests must respect residential peace between 10:00 PM and 8:00 AM, in observance of community noise regulations.

5.2 Property Damages & Security Deposits

Guests are financially liable for leaving the property and its contents in the state in which they arrived. In the event of documented breakage, missing appliances, or severe staining, Roominac reserves the right to charge the guest's vaulted payment method for the actual replacement or repair cost, supported by verifiable receipts and host documentation.

6. Cancellation Policy Matrix & Force Majeure

To maintain equity between guest schedule flexibility and host revenue preservation, Roominac enforces category-specific cancellation tiers:

6.1 Pakistan-Specific Force Majeure Circumstances

Roominac provides relief from standard cancellation penalties when a trip is rendered impossible due to verifiable extraordinary events:

• Severe Northern Route Disruptions: Landslides, snow blockages, or flash floods affecting transit corridors in Murree, Swat, Naran-Kaghan, Gilgit-Baltistan, or Azad Kashmir, substantiated by National Highway Authority (NHA) or NDMA alerts.
• Declared National Emergencies: Civil curfews, natural catastrophes, or government-mandated travel restrictions.
• Medical Emergencies: Severe unforeseen hospitalization of the primary booking holder, subject to authenticated hospital admission records.

7. The 24-Hour Stay Guarantee & Dispute Resolution

Your peace of mind is guaranteed on every verified booking. If a property severely deviates from its listing description or a host is non-responsive at check-in:

7.1 Resolution Protocol

1. Evidence Submission: Submit high-resolution photos or video clips directly through the Resolution Center in the mobile or web app detailing the deficiency (e.g., broken AC, non-functioning plumbing, unsafe conditions).
2. Host Mediation: The host is afforded a 2-hour window to remediate the issue or provide an equivalent upgrade on premises.
3. Relocation or Full Refund: If the issue cannot be resolved, Roominac immediately freezes the escrow payout, assists the guest with priority booking at a nearby partner stay, or processes a 100% refund of all fees paid.

8. Platform Service Fees, Taxation & Invoicing

Roominac charges service fees to maintain continuous platform operations, cloud hosting, 24/7 concierge support, and payment gateway infrastructure:

• Host Commission: A standard percentage commission (typically between 5% and 10%) is deducted from the gross room rate before disbursing host payouts.
• Guest Service Fee: A nominal transparent platform fee is added to the checkout total, providing access to our 24-Hour Stay Guarantee and customer care hotline.
• Provincial & Federal Taxation: In compliance with federal and provincial tax laws (Punjab Revenue Authority - PRA, Sindh Revenue Board - SRB, KPRA, and ICT sales tax), applicable sales taxes on services are applied and remitted to statutory authorities.

9. Intellectual Property, Video Tours & Media Rights

All trademarks, logos, brand names, visual styling, source code, and design tokens of Roominac are the exclusive proprietary property of Roominac Interactive Technologies (SMC-Private) Limited.

By uploading photos, descriptions, or short-form video reels to the platform, hosts grant Roominac a worldwide, non-exclusive, royalty-free, perpetual license to display, optimize, and market the media across search engines, social channels, and advertising campaigns for the sole purpose of promoting the host's accommodation.

10. Limitation of Liability, Utility Disclaimers & Indemnity

To the maximum extent permitted under Pakistani law:

• Marketplace Intermediary: Roominac operates as a technology marketplace connecting independent hosts and travelers. We do not own, control, or employ the staff at third-party properties.
• Municipal Utilities: Roominac is not liable for temporary city-wide utility failures (including WAPDA/K-Electric grid failures, municipal water pipeline rationing, or cellular/ISP broadband outages), provided the host accurately communicated their backup capabilities.
• Aggregate Cap: Roominac's total aggregate liability arising out of or relating to any booking shall not exceed the total booking fees received by Roominac for the specific transaction in dispute.

11. Account Termination, Suspension & Deletion

Roominac reserves the right to immediately suspend or permanently terminate any account that engages in discriminatory behavior, identity forgery, harassment of staff or hosts, fraudulent chargebacks, or violations of these Terms.

Users may voluntarily close their account and initiate complete data deletion at any time via the Mobile App Settings (Settings > Delete Account) or through our dedicated Data Deletion Portal, in full alignment with Apple App Store and Google Play data privacy directives.

12. Governing Law & Dispute Resolution Forum

These Terms and all platform engagements are governed exclusively by and construed in accordance with the laws of the Islamic Republic of Pakistan, including the Prevention of Electronic Crimes Act, 2016 (PECA) and the Contract Act, 1872.

Any dispute, controversy, or claim arising out of or relating to these Terms that cannot be settled amicably through Roominac's Resolution Center shall be subject to the exclusive jurisdiction of the competent courts of Islamabad Capital Territory (ICT), Pakistan.
